These Terms of Service ("Terms") govern your access to and use of the websites, APIs, and file-delivery services operated under bottleneck.cc and apis.bneck.com (the "Service"), provided by [OPERATOR LEGAL NAME / SOLE PROPRIETOR / ENTITY] ("we", "us", "our").
By creating an account, generating an API key, or uploading, sending, or downloading any file through the Service, you agree to these Terms and to our Acceptable Use Policy and Abuse & Takedown Policy. If you do not agree, do not use the Service.

The Service lets you upload files and create links to deliver them to others. Links may be configured to be single-use, time-limited (expiring), and/or password-protected. We also offer a developer API for generating single-use and expiring signed URLs, and free metadata-stripping micro-tools.
When you upload certain file types, our systems automatically remove embedded metadata (for example, EXIF data in images and document metadata in PDFs) before delivery. This is an automated technical process. It is not an anonymity, encryption, or zero-knowledge guarantee - see Section 6.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
You are responsible for all activity under your account and API keys. Keep your credentials confidential. Notify us promptly at the contact in Section 14 if you believe your account or keys have been compromised.
Sender identity. Use of the Service requires a verifiable sender identity (such as a registered account and/or a valid API key tied to your account). We do not offer anonymous file sending. We may associate uploads and links with your account for security, abuse-prevention, and legal-compliance purposes.
Your use of the Service is subject to the Acceptable Use Policy, which is incorporated into these Terms by reference. Among other things, you may not use the Service to store, send, or link to malware, phishing content, child sexual abuse material (CSAM), or content that is illegal or that you do not have the right to share. Violations may result in immediate removal of content, suspension or termination of your account, and reporting to law enforcement.
You retain ownership of the files you upload ("Your Content"). You grant us a limited, non-exclusive license to store, process, transmit, and deliver Your Content only as necessary to operate the Service - for example, to strip metadata, generate links, scan for prohibited content, and deliver files to recipients you designate. This license ends when the content and its links expire or are deleted, except for backups and logs retained as described in our Privacy Policy and Section 12.
You represent and warrant that you own Your Content or have all rights and permissions necessary to upload and share it, and that doing so does not violate any law or third-party right.
Free (unauthenticated) transfers are limited to 50 MB per file. Larger transfers, up to 5 GB per file, require an authenticated/signed request and may require credits or a paid plan. We may enforce file-size, rate, storage, and bandwidth limits, and may change them at any time.
Prepaid credits. Paid usage of the Service operates on a prepaid credit basis. You purchase credits in advance; eligible actions (such as large transfers or API calls) consume credits at the rates published on our pricing page at the time of use. Credits are a prepayment for future use of the Service. Unless required by law, purchased credits are non-refundable and have no cash value. Credits may expire after [INSERT PERIOD, e.g. 12 months] of account inactivity. We may change pricing and credit rates prospectively; changes do not affect credits already consumed.
Payments are processed by a third-party payment processor. We do not store full payment-card details. You are responsible for any taxes associated with your purchases except taxes on our net income.
The Service is not an end-to-end encrypted, zero-knowledge, or anonymous delivery service. We process files server-side (including metadata stripping and abuse scanning), which means we are technically able to access file contents. Do not use the Service to transmit information that legally requires end-to-end encryption or that you are not permitted to disclose to a service provider. You are solely responsible for assessing whether the Service is appropriate for your data.
The Service is operated by a small team and is provided on a best-effort basis. We do not guarantee any specific uptime, and we may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We are not liable for any unavailability of the Service or for the deletion of expired or single-use content (which is the intended behavior).
We may suspend or terminate your access to the Service, remove or disable any content, and revoke API keys, at any time and without prior notice, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law, or to protect the Service, our users, or third parties.
You may stop using the Service at any time. You may request deletion of your account by contacting us at the address in Section 14. Sections that by their nature should survive termination (including Sections 4 (representations), 9, 10, 11, and 13) survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT METADATA REMOVAL OR FILE DELIVERY WILL BE COMPLETE OR ACCURATE. YOU USE THE SERVICE AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide reasonable notice (for example, by posting a notice on the Service). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
